The University of Illinois Police Department says basketball player Jamar Smith was driving drunk when he crashed his car into a tree Monday, February 12th.  Police say Smith crashed the car on First Street, in Champaign, then drove it to his apartment complex, College Fields, in Savoy.  That’s where police say he left his car, with teammate Brian Carlwell inside, and unconscious.

The State's Attorney's Office is charging him with leaving the scene of an accident where someone was injured and with aggravated driving under the influence.

Julia Rietz says, “ we plan on handling this case the same as we handle every other case of this type.  We look at this as a very serious situation we will treat it as so.  We will not treat him any harder or easier based on status as an athlete."

Witnesses say they thought he was drunk, and now the toxicology reports back that up.

"We saw people standing around, listened to cops saying he didn't want to go in an ambulance and we didn’t know why.  The only reason we could think is maybe he'd been drinking.”

The State Police lab says Smith’s blood alcohol level was .176, that’s twice the legal limit.   If convicted of the two felony charges, Smith could be looking at anywhere from probation to twelve years in jail. He has no prior record.
