A 3-year-old boy is recovering after his mothers boyfriend is accused of beating him to the point of breaking his leg.
Investigators say it happened last night (Sunday) after they were to St. Johns Hospital ... Health workers say the boys injuries were consistent with child abuse.
20-year-old Jessie Fishburn is still in jail tonight.
A broken femur, bruises, red marks all over his body and cut on the ear ... Thats what a 3-year-old boy is suffering from tonight (Monday).
Investigators say no one was home at the time except for the moms boyfriend ... 20-year-old Jessie Fishburn.
Hes on parole for a gun violation so he wont be getting out of jail anytime soon.
Investigators say he lived in a trailer park off East Enos Avenue .... they wont say how it happened ... But the toddler was brought into St. Johns hospital by a family member.
Now he could face anywhere from six to 30 years in prison.
"Our society recognizes that our legislature recognizes that next to first degree under its the most serious crime that we have. There is first degree murder and Class X felonies. This individual is charged with a Class X felony. " Said Sangamon County States Attorney, John Schmidt.
Fishburn faces aggravated battery of a child ... His bond is set at 75 thousand dollars ... Because he violated parole ... He could have a harder time getting out of jail.
Fishburn is back in court on July 5th.
Investigators say the mother is not involved in the alleged abuse.
The toddler got out of surgery this morning (Monday) ... His condition is unknown tonight (Monday).
