Mackenzie Seiler was visiting friends at the U of I and stopped by this Jimmy Johns.
Because of his allergies he ordered a Turkey Tom, no mayonnaise, no cheese.
What he got was a tuna sandwich with mayo.
He took a bite and got sick.
Now he's taking Jimmy John's to court. His lawyer says he spent three days in the hospital and Jimmy Johns should pay. He's asking for more than $50,000. Some sub lovers in Champaign say he should have checked his order before he bit in. "I just check and make sure and then I just take out whatever I don't want or I've gone back in and they've fixed it but suing for $50,000, that's a little intense," said U of I student Marina Elkins. "I think it's crazy for $50,000 it is a health issue but still kinda weird, I mean it's Jimmy Johns!" said U of I student, Valeri Warren. The lawyer says they've been trying to resolve the issue out of court for the last two years. But he says Jimmy John's wouldn't pay up. Jimmy John's can't comment because it's an ongoing issue. The lawsuit is accusing the restaurant of negligence. |
